2.- INFORMATION AND CONSENT

By accepting this Privacy Policy, the User is informed and gives their free, informed, specific, and unequivocal consent for their personal data to be processed by Oberon Abogados.

3.- FOR WHAT PURPOSE WILL OBERON ABOGADOS PROCESS THE USER’S PERSONAL DATA?

The personal data provided by the User will be processed by Oberon Abogados for the following purposes:

  • To carry out the provision of contracted services, maintain the contractual relationship, and follow up on it, as well as to conduct satisfaction surveys.
  • To manage, process, and respond to requests, inquiries, incidents, complaints, claims, or queries from the User.
  • To manage the sending of commercial communications about products and services marketed by Oberon Abogados through electronic and/or conventional means.
  • To create a commercial profile, using internal sources, in order to offer the User products and services according to their interests.
4.- HOW LONG WILL OBERON ABOGADOS RETAIN THE USER’S PERSONAL DATA?

User data related to the fulfillment of the contractual relationship will be kept for the duration of the contract and, even after, for the entire period required by applicable legislation and until any potential liabilities arising from the contract are time-barred. Regarding the sending of commercial communications, Oberon Abogados will process the User’s data until the User objects to it.

5.- WHAT USER DATA WILL BE PROCESSED?

Oberon Abogados will process the following categories of User data:

  • Identification data: Name, Surname / Company Name.
  • Contact data: Mailing address, email address, and phone number.

In the event that the User provides third-party data, they declare to have obtained the consent of those individuals and undertake to provide them with the information contained in the Privacy Policy, releasing Oberon Abogados from any liability in this regard. However, Oberon Abogados may carry out periodic verifications to confirm this fact, taking appropriate due diligence measures in accordance with data protection regulations.

6.- WHAT IS THE LEGAL BASIS FOR PROCESSING THE USER’S DATA?

The processing of the User’s data by Oberon Abogados for the purpose of sending commercial communications, creating profiles, and conducting satisfaction surveys is based on the legitimate interest of Oberon Abogados in accordance with the provisions of the GDPR. On the other hand, the processing of the User’s data to manage, process, and follow up on purchases made by the User is based on the performance of the sales contract. Therefore, the provision of data for this purpose is mandatory and its non-provision would prevent the fulfillment of the contract.

7 – TO WHICH RECIPIENTS WILL THE USER’S DATA BE DISCLOSED?

User data may be disclosed, solely to Public Administrations in cases provided by Law.

8 – COMMERCIAL AND PROMOTIONAL COMMUNICATIONS

One of the purposes for which Oberon Abogados processes the personal data provided by Users is to send them commercial communications by electronic and conventional means, providing information about products, services, promotions, offers, events, or relevant news for Users. Whenever such communication is made, it will be directed only to those Users who have not previously expressed their refusal to receive them. If the User wishes to stop receiving commercial or promotional communications from Oberon Abogados, they can request to unsubscribe from the service by sending an email to the following email address: [EMAIL ADDRESS] or by using the unsubscribe link provided in the footer of promotional emails.

9 – EXERCISE OF RIGHTS

The User may send a written request to Oberon Abogados or an email to legal@oberonabogados.com, with the reference “Data Protection,” attaching a photocopy of their identity document, at any time and free of charge, to:

  • Withdraw their given consent.
  • Obtain confirmation as to whether Oberon Abogados is processing personal data concerning the User or not.
  • Access their personal data.
  • Rectify inaccurate or incomplete data.
  • Request the erasure of their data when, among other reasons, the data is no longer necessary for the purposes for which it was collected.
  • Obtain from Oberon Abogados the restriction of data processing when one of the conditions provided by data protection regulations is met.
  • Request the portability of their data.
  • File a complaint with the Spanish Data Protection Agency through the following address: https://www.agpd.es if the data subject believes that Oberon Abogados has violated their rights recognized by applicable data protection regulations.

10 – OBERON ABOGADOS’ SECURITY MEASURES

Oberon Abogados will treat the User’s data at all times as strictly confidential and will observe the required duty of secrecy regarding such data, in accordance with the applicable regulations. Oberon Abogados will adopt the necessary technical and organizational measures to guarantee the security of the data and prevent its alteration, loss, processing, or unauthorized access, taking into account the state of the technology, the nature of the stored data, and the risks to which it is exposed.
